AR-LWT-Mutual

This Arkansas Last Will and Testament (Joint and Mutual) satisfies the requirements for validity in every state.  This means if you own property outside the state, this Will can be admitted to probate in the other state and still be valid.

The primary purpose for this type of Will is for a couple to decide now who will inherit the couple's property when the last surviving spouse passes away.  Many couples want to make sure the children born of their marriage inherit the property accumulated during the period of their marriage, and not the spouse or children of any subsequent marriage.

This document also allows the couple to, among other things, determine:

(1) who will manage the estate when the last surviving spouse passes away,

(2) who will inherit the home when the last surviving spouse passes away,

(3) who will inherit the couple's personal property when the last surviving spouse passes away, and

(4) who will be Guardian of the couple's minor children when the last surviving spouse passes away.
